About these terms

These terms apply when Tivaro Digital ("we", "us") designs, builds or looks after a website for you. By approving a website or starting a care plan, you agree to them. Anything we agree with you in writing for a specific project takes priority over these terms.

Quotes and previews

Before we start, we agree with you what we will build and a fixed price. We then build your website at our own cost and show it to you on a private preview link.

Until you have approved it and paid in full, the preview and everything in it belongs to us. Please don't copy it, publish it or have it rebuilt elsewhere.

You are under no obligation to go ahead. If you decide the website is not for you, you can decline it at any time before approving, and you will owe us nothing.

Changes

Changes you ask for before approving are included, as long as they stay within what we agreed. If you ask for something significantly different or larger, we will tell you if it affects the price before we do it.

Approval and payment

When you approve your website, we send you an invoice for the agreed price. Invoices are payable by bank transfer within 14 days, using the invoice number as the reference. We put your website live once payment has cleared.

Prices cover the design, build and launch of your website. Domain names, SSL certificates, hosting and other third-party costs are not included: they are charged separately and shown in your quote before you approve it.

Ownership

Once you have paid in full, the design and content of your website are yours. We keep the right to reuse our own general-purpose code and tools in other work, and to show your website in our portfolio unless you ask us not to.

You confirm that you have the right to use any text, photos, logos and other content you give us for your website.

Domains

We register your domain on your behalf. If you take a care plan, we renew it for you. Domain and SSL costs, including renewals, are charged separately. If you choose a handover, or end your care plan, we transfer the domain into your name and hand over your website files.

Care plans

Care plans are billed monthly in advance by bank transfer. You can cancel at any time by giving us 30 days' notice. When a care plan ends, we hand over your website and domain, and you become responsible for hosting and renewals.

Care plans do not include changes or new work. We quote any changes you ask for before starting, and invoice them separately once agreed.

Third-party services

Some websites rely on other services, such as payment providers, email providers or mapping. Their fees and terms are between you and them, and we are not responsible for their availability.

Our responsibility to you

We build every website with care, and we will put right anything that does not work as agreed. We are not liable for indirect losses, such as lost profits or business, and our total liability for any project is limited to the amount you have paid us for it in the previous 12 months. Nothing in these terms limits liability that cannot be limited by law.

Law

These terms are governed by the law of England and Wales.
